				<content:encoded><![CDATA[<p>This month, the Ninth Circuit Court of Appeals vacated a conviction and granted a new trial, ruling that the trial judge should have given a jury instruction regarding the governments negligent destruction of evidence.  In <strong><em>United States v. Sivilla</em>, No. 11-50484 (9th Cir. May 7, 2013, </strong>the Court found that that while the government was negligent in destroying an S.U.V. that was used to transport drugs, this negligence didn&#8217;t warrant dismissing the case.  However, the government&#8217;s negligence did deprive Mr. Sevilla the opportunity to present a full defense, since he couldn&#8217;t use helpful evidence from the vehicle. </p>
<p>This important decision has many applications outside of drug cases.  In many white-collar cases, the government seizes business documents pursuant to subpoena.  Some of these documents have exculpatory value, meaning they tend to show that the defendant is not guilty.  When these documents go missing, as we all know can happen, the trial judge must instruct the jury that they can infer that the destroyed evidence was helpful to the defense.  Wouldn&#8217;t you love to have a judge give that instruction in your trial?</p>

<ul>
<li>AB 397 – Contractors must recertify workers’ compensation exemptions when they renew their licenses.</li>
<li>AB 2219<b> – </b>Roofing contractors must have workers’ compensation insurance, even if the contractor does not have any employees.</li>
</ul>
<p>Failure to maintain insurance where required may result in an automatic suspension of a contractor’s license. Accordingly, it is imperative that contractors ensure they have the appropriate coverage before performing any work.</p>

<p>The new Form I-9 has a different format and has updated information reflecting changes since the last edition was published. Additional information was provided evidencing that employees from Honduras and Nicaragua that have EAD cards have an automatic extension even if the new EAD card is not yet available. 				<content:encoded><![CDATA[<p>Recently, the San Diego City Council approved two measures which will allow restaurants and breweries to expand.  Following a year-long effort by local restaurants, the City will ease the approval process for sidewalk cafes through streamlining the application process and a reduction in permit fees.  The City Council also approved a plan that will allow breweries to open larger tasting rooms.  Previously, breweries were limited to tasting rooms of 3,000 square feet.  Under the new ordinance, breweries can utilize up to 25% of their total square footage for tasting rooms.</p>

				<content:encoded><![CDATA[<p>Alexis Gutierrez has obtained de-certification of a 120,000+ member, multi-million dollar, certified class action brought against Sharp HealthCare.  After 5-1/2 years, Alexis defeated a previously certified class action lawsuit brought against Sharp Healthcare for alleged violations of California&#8217;s Unfair Competition law and the Consumer Legal Remedy Act (CLRA).  The case is captioned <em>Hale, et al. v. Sharp Healthcare</em>.  (This case, and a companion class action suit, <em>Durrell, et al. v. Sharp Healthcare</em>, previously resulted in reported decisions.)</p>
<p>Sharp HealthCare is a not-for-profit integrated regional health care delivery system based in San Diego, Calif. Sharp includes four acute-care hospitals, three specialty hospitals and two affiliated medical groups, plus a full spectrum of other facilities and services.</p>

				<content:encoded><![CDATA[<p>The Diversity Immigrant Visa Program makes available up to 55,000 diversity visas annually, draw from random selection among entries from individuals that meet specific requirements from countries with low rates of immigration to the U.S.   Individuals that met the criteria, including country restrictions, were permitted to submit an application electronically between October 2, 2012 and November 3, 2013.  The drawing is for fiscal year 2014 which starts on October 1, 2013, and ends September 30, 2013.   On May 1, 2013, USCIS announced that individuals that applied for the diversity visa lottery can check online to see if they were selected since the drawing has taken place.   The individuals can check online at the USCIS webpage for diversity visa at the following site:  <a href="http://travel.state.gov/visa/immigrants/types/types_1322.html">DV Lottery.  </a></p>
