Dear clients and friends:

We continue to make progress at San Diego's law firm in ever expanding the services that we can provide to our wonderful community. This summer we have welcomed back Paul Pfingst, our former partner and the past District Attorney for the County of San Diego. Paul will head up our new business crimes and complex criminal litigation practice group.

The Firm was also successful in adding four new corporate and business and estate planning partners to our transactional practice group. These new partners, Jim Harrigan, Greg Pyke, Susan Mercure and Marco Garavaglia, have been practicing together for over ten years. We are so proud to add them to our organization because they epitomize the quality of person and legal professional which our clients have come to expect from San Diego's law firm.

In this edition, we have provided a brief biographical sketch of one of our very talented young attorneys. This edition also includes an article on new telemarketing legislation that may catch unsuspecting business owners by surprise. The article is by Michael Nalu, a senior associate in our civil litigation practice group. We hope that you find these articles helpful. If we can address any of your needs, please contact any of us, through e mail or the direct dial phone numbers set forth in the last section of this edition.

Again, we thank you for your interest in our Firm. Higgs, Fletcher and Mack wishes you the very best.

Very truly yours,

John L. Morrell, Chairman
.

While serving as San Diego DA, he was recognized by Time Magazine as one of the country's top "innovators in justice." Mr. Pfingst's practice will focus in the areas of civil and criminal law, election law, and professional licensing issues. Paul and Connie Pfingst and their two children reside in Del Mar.

For Businesses Relying on Telemarketing Each "Wrong Number" Can Cost $11,000
The Telephone Consumer Protection Act ("TCPA") reaps extraordinary fines and civil penalties from the often-unknowing business that engages in automated telephone or fax advertising. If the potential damages were not already enough, under the newly enacted TCPA legislation, beginning this summer, fines have been increased from $500 to $11,000 for each violation.
